Ask Dan: Why Isn’t It Illegal to Drain the Social Security Trust Fund?

Here at The Seniors Center, we advocate returning Social Security to its origins as a trust. We also advocate repaying the money that was stolen from it.

This brings up an interesting question: Why isn’t taking money from this fund illegal? For the answer, we turn to our founder Dan Perrin.

He says: “In 1960, The US Supreme Court ruled that people who paid into the Social Security Trust Fund do not have a Constitutional Right to Social Security benefits. Which frees Congress up to spend the money in our Social Security Trust Fund however they want.”

Does this seem like fair treatment of taxpayers? This is one reason why we spread the word and encourage advocacy to repair and refill the Trust Fund. Because if paying into this fund doesn’t give us a right to be paid back, what are we really paying for at all?
